Under many of these state laws, it is still illegal to use marijuana recreationally, but prosecutors do not press criminal charges. Instead, offenders face civil penalties, which usually include fines or drug education programs. However, in Texas, people arrested or cited for marijuana possession may still face legal penalties depending on the amount. Widespread cannabis use is evidenced by the increasing number of people failing marijuana tests.#160;In 2021, positive drug tests soared to their highest level in two decades, according to Quest Diagnostics, which provides drug-screening services.#160;Positivity rates for marijuana in the general U.S. workforce rose 8.3 percent (from 3.6 percent in 2020 to 3.9 percent in 2021). The 2021 number represents#160;the highest positivity rate ever reported in Quest's drug-testing index.
